  • What is a surrogacy law in NSW?

    A surrogacy arrangement arises when a woman ("the birth mother" or "the gestational mother") agrees to give birth to a child who is then given to another person or persons ("intended parents") who intend to take responsibility and care of the child on a permanent basis.

  • Who are the parties in a surrogacy arrangement?

    Typically, surrogacy arrangements are between a heterosexual couple who have undergone IVF treatment but who have been unable to give birth to a child and a birth mother who is prepared to become pregnant with an egg donated by either the female partner, or, alternatively another egg donor and who will then surrender the child to the intended parents upon birth; gay or same sex male couples also enter into surrogacy arrangements with a birth mother.

  • Who are the legal "parents" of the child?

    Section 60H of the Family Law Act 1975 provides, in effect, that a child's "parents" are the woman who has given birth to the child and her husband or de facto partner even though the child does not have their DNA (and not the intended parents).

    Section 61 of the Family Law Act 1975 provides that "each of the parents of a child who is not 18 has parental responsibility for the child."
